This agreement entered into by and between
Ang kasunduang ito sa pag-itan ng


Greenhills Development Corporation  a corportion organized and subsisting under the laws of the Philippines with principal office at Wilson Greenhills San Juan Rizal, herein represented by ___________________herein known as the LANDOWNER (May ari)

                                       and

    _____________________ m/single/separated  of legal age, and resident of Barandal Calamba City known as GRANTEE/USUFRUCTUARY  (PINAGBIBIGYAN NG KARAPATAN)

Whereas

1.  The grantee has been a settler of the land of the owner for the past __years
     Ang PINAGBIBIGYAN NG KARAPATAN ay tumira ng pahintulot sa lupa ng MAY ARI
     (nang hindi bababa ng 3 taon) ____nang taon at siya ay pinaalaahanan palagi ng illegal
     na pag okupa ng nasabing lupa at inaabala
and that our continued stay there has been questioned and disturbed;

2. Whereas the time has come to develop the property and it is necessary to relocate the GRANTEE

    Sapagka't dumating na ang panahon na gagamitin na ang lupa ng MAY ARi at kailangan nang umalis
     ang PINAGBIBIGYAN NG KARAPATAN.


3. Whereas, due to the generosity of the LAND OWNER, they have set aside an area to relocate the Grantee to lessen the disturbance for the GRANTEE but under a right to use agreement
    Sa kagandahang loob ng MAY ARI, nag bukod ito ng lupa para gamitin muna ng mga PINAGBIGYAN NG KARAPATAN para mabawasan ang mga problema ng paglipat at mamuhay muna ng matiwasay. sa pamamagitan ng KASUNDUANG USUFRUCT 
(pagbibibay ng karapatang gamitin ang ari arian na walang babaguhin)

WITNESSETH
Napagkasunduan

For and in consideration of the above premises, the Landowner have granted unto the Grantee a usufruct (right to use) of parcel of land located at the back of Holy Gardens Memorial Park, at the southern portion near the San Juan River

Sa pamamagitan ng mga nasabing mga informasyon, ang MAY ARI  ay magbibigay ng karapatang gamitin muna ang bahagi ng 
kanyang pag mamay ari ng may sukat ng 3,000 metro kuadrado humigit kumulang sa may kanlurang bahagi ng kalakihan ng lupa
sa tabi ng ilog ng San Juan, na pinaghahati 



             With the following description
             Na nakamarka sa mapa:

            Area,
           Lot Number
           Block Number

TERMS AND CONDITiONS
 MGA KONDISYONES

1. TERM of usufruct 50 years from signing with option on the part of the LAND OWNER TO RENEW.
     HABA NG PANAHON ng USUPRUKTO (Kasunduan)  50 taon limitado sa unang henerasyon lamang

2 .ASSIGNMENT AND TRANSFER.. Non assignable non transferable.   A transfer or assignment voids and terminates this agreement;
    PAGLILIPAT NG KARAPATAN     Ito ay hindi puwedeng ilipat o ipaokupa kanginoman liban sa pinagbigyan ng karapatan. Mababaliwala
    itong kasunduang ito sakali may paglilipat na magaganap

3.  EFFECT OF DEATH.      This causes the transfer of right to use to the eldest son/daughter named _________________after whose death or end of 50 years, this usufruct ends.

    EPEKTO NG PAGKAMATAY NG PINAGBIGYAN NG KARAPATAN.  Ang karpatan ay malilipat sa pinakamatandang anak na ang
    pangalan.  Oras na mamatay ang anak o umabot ang 50 taon, ang kasunduang ito ay magtatapos mawawlang bisa

4. Utilities and right of way.  This is not a a subdivision project and the GRANTEE waives rights and complaints for such a project under PD 957 and BP 220. like water electricity, pathwalk open space and the like. Neither this  CMP program  The grantee shall look for their own right of way and shall not be allowed to use the memorial park as a pass thru egress ingress to the area.

   Mga gamit ng subdivision na kuryente, tubig at Right of Way.   Itong lupaing ito ay hindi isang subdivision sa ilalim ng batas PD
   957 o BP 22, at isinasangtabi ng mga kailangang mga gamit sa isang nasabing proyekto at hindi magrereklamo a hihilingin ng mga
   mga kailangan sa isang subdivision project gaya ng parks at play ground, tamang sukat ng kalsada, tubig at kuryente..  Ang mga binigyan ng karapatan ay maghahanap o hihiling sa ibang partido ng daraaanan at hindi sila pinahihintulutan na gamitin ang memorial
  park bilang right of way.

5.  Waiver for requirements of PD 856 - Sanitation Code.   The usufruct f area is  a setback under such code.  The grantee can not invoke the 25 nor the 50 meter setback as condition for the location of the usufruct grant

     Pagsasalawang halaga ng set back ng PD 856.  Ang lugar ng usuprukto ay set back ng memorial park sa tabing ilog at ang 
     PINAGBIGYAN AY hindi maaaring magreklamo sa probisyon ng PD 856.  sapagkat ang memorial park ay naunang itinayo ay
      inaprobahan bago dumating ang mga pinagbiyan ng karapatan

6.  CLEANLINESS AND ORDERLINESS. Good housekeeping and maintenance.. The Grantee shall keep the 
settlement under good state of cleanliness and hygiene proper drainage  and provide for their own sanitary and hygienic facilities (sanitary toilets) and proper solid waste disposal under the DENR regulation on solid waste management

     KALINISAN AT PAGSASAAYOS.   Ang pinagbigyan ng karapatan ay pananatilihing maayos at malinis ang tinitirahan, walang kalat at 
     at lusak at magtatayo at gagawa ng sariling drainage at mga kubeta para sa tamang hygiene at sanitasyon

The area is crowded and therefore growing pigs and simiilar livestocks which will cause unhygienic conditions is not allowed.
 Sapagkat ang bahay ay tabi tabi at katabi ng memorial park, ang pag aalaga ng baboy at iba pang makalat na hayop ay mahigpit
 na hindi pinahihintulutan ng kasunduang ito


7. Good behavior and conduct. The grantee represents that he/she is of good moral character, and has not been convicted of crimes of any nature or kind..  Any misrepresentation shall be a cause for immediate voiding of this grant

    Mabait at walang gulong pamumuhay. Ang pinagbigyan ng karapatan ay pinatutunayan at sinasabi na siya ay mabuting tao at mama
     mamayan at anumang panggugulo ay magiging dagliang dahilan para bawiin ang pagbibigay ng karapatan or pagsasawalang bisa 
     ng kasunduang ito.

Likewise, the GRANTEE shall not cause any trouble fistfight, rumble and in any manner engage in trouble with the neighbors, or commit crime of any type which includes but not limited ot use and distribution of prohibited drugs and illegal gambling...  Any such act shall be a ground for the immediate cancellation and revocation of this agreement .

     Gayundin ang pinagbigyan ng karapatan ay hindi pagmumulan ng away, gulo, at pakikipagtalo sa mga kapitbahay at iba pang
      residente. na kasama ang pagbebenta, tulak at paggagamit ng droga sa ilalim ng batas RA 9165.   Ang anumang paglabag sa
      sa nasabi ay sapat na dahilan para bawiin ang nasabing karapatan.

8. COMPLAINTS Any complaint against the land owner be it administrative or judicial shall be a ground for the cancellation of this usufruct.  Likewise all pending criminal complaints vs Holy Gardens and the Grantor shall be withdrawn and  released. 

     MGA REKLAMO LABAN SA MAY-ARI.   Anumang reklamo laban sa May ari, at ang negosyo sa katabing lupain, sa korte o anumang      ahensiya ng pamahalaan ay sapat na dahilan upang bawiin pawalang bisa ng USUPRUKTO.  Kung mga reklammo ang PINAGBIGYAN
     ng karapatan sa ngayon na nag iisa o kasama  iba pang mga tao ay sapat na dahilan para mawalang bisa ang USUPRUKTONG ITO
  

9. PROHIBITIONS.   Elective and appointive City and barangay official are disqualified from being a grantee.  However excess lots may be allocated for staff housing...

    MGA PAGBABAWAL   Ang mga kawani ng local na pamahalaan, nahalal o naitalaga ay walang karapatang makakuha ng                       ng USUPRUKTO/KASUNDUANG ITO

9.  Fees and dues.   This usufruct is  free no fees of any kind shall be paid nor collected from the grantees including real estate taxes being an excluded area. Any fees that may be collected shall only accrue to a duly organized and registered Homeowners association.

     MGA BAYAD AT KOLEKSYON.    Ang usuprukto ay libre liban sa P1,000 na bayad sa documento at walang anumang hihilinginng
     bayad o kolkesyon. mula sa mga PINAGBIGYAN.   Gayunman, walang anumang gagastusin ang MAY ARI SA PAGPAPATUPAD 
     kasunduang ito (relocation expenses?)  ..

Nag comment na ba  ang abogado, Naistagalog na.  Dapat asikashuhin na natin dahil naaabala ang construction.  The sooner matapos natin ito.  Walang relocation expense kasi same place.

Study also the feasibility of building bridge between the park and Turbina para may easy access tayo sa customers from Turbina. Will build traffic..
