Notation: Request for donation by Parish Priest of Lawa: plot and 50% discount interment fee

1. To carry our our vision of providing affordable memorial service to every one
2. To promote more awareness of Holy Gardens to the religious at Calamba
    Catholics and prayer groups like Pag Ibig sa Diyos
3.  To support the advocacy of Mr. Henry Tanedo, President of Pag ibig sa Diyos group in promoting faith and love (faith with action)


Background:

As per your text report and our telephone conversation, the Parish Priest of Lawa went to your office with the following  request, reporting that he knows Mr. Henry Tanedo (which was later confirmed to be incorrect)

       1.  Donation of a plot 
       2.  50% discount on the interment

which under our present sales policy and joint venture agreement is not allowed exceeds the limit (only maximum of 10%) 

Resolution:

This office suggested proposed

    Usufruct or Assignment of Right to Use by us  (Holy Gardens Greenhills)
for five years to the user (assignee - the dead sacristan) after which the remains can be cremated and cremains be brought elsewhere P1,000 documentation charge for Usufruct,   50 % discount on cremation by having basic bare interment package...P15,000.

   Total cash out from the good father:   P15,000 +  P1,000 =   P16,000

    The good parish priest will make a written request to us to document this transaction.

    This was communicated to Mr. Henry Tanedo and Ms. Madelene R. Saguinsin and they interposed no objection/probably agreed.

   As per your latest text, the  good Father has submitted a written request, is thankful and proposed that the family will buy the plot subject of usufruct

  This memo documents confirms all our conversation regarding the said event.

Should there be no comment, in two days, this memo is deemed OK with everyone.

Estate management strategy for a business partner


A business partner whose husband just died is frantic because her husband died 30 days ago and the transfer of the property left intestate has not been fixed. What could be the solution?  He friends suggested a simulated sale,

We talked about simulated sale to save on estate taxes  which used to be up to 40% before.  Indeed what are the options.... All the three  options:  donations, estate tax, and sales are at 6%...

1.  The  donors tax and estate tax are now low at 6% under the Train Law

BIRR 12 2018  Estate Tax

Removed deduction funeral medical, legal and judicial expenses;

Cost of home up to P10 million  deduction is  allowed, P500,000 standard deduction

Estate of more than P2M to be filed by a CPA, estate tax can be paid within 2 years    From Tax Alerts

2.  Donors tax.  6%, P250,000 is exempt every year. Deduction and terms of payment are not available


2.  For simulated sale,  it also 6% but may be subject to VAT if capital goods (if say being sold as subdivision lots)  + 1.5 doc sci (lumilitaw na mas mahal)

and no deductions are allowed...

BETTER ANG TO GO BY WAY OF ESTATE TAX

3.  For sale

     It is also 6% but may be subject to vat (total of 18%)  if used as ordinary asset say lots for sale in a subdivision +  1.5% doc sci and this makes the simulated sale more expensive than estate tax payment

For Sellers, the property to be sold should be a capital asset, and this includes assets that derive no rental income. Under this category, it’s the seller’s responsibility to cover the Capital Gains Tax of 6%.  If classified as an ordinary asset, a VAT will be imposed. More importantly, Creditable Withholding Tax is imposed for ordinary assets habitually sold by the seller.
For Buyers, it’s their responsibility to pay for the Documentary Stamp Tax (1.5%), the Transfer Tax (rates will vary depending on the location of the property), the registration fee, as well as other related fees like the notary fee.

Invitation to join an Evangelization Program of Bible Expedition

                                                     Why the Bible and eyeglasses go together


This post was invited several times all ready by  a friend in the past Dale Abenojar, sa 4x4 adventures to donate to an Evangelization program.  This would cost P40.00 for the full size Bible, and P15.00 for the reading glasses.  According to him they will donate

                             20,000 Bibles   x P40.00    =                P800,000

                             10,000 Reading glasses  x P15.00    =  P150,000

                                             Total                                      950,000

to 10 municipalities of Occidental Mindoro.

Why the large bible?   So that the elderly, those with poor eyesight can read?
Why the  eyeglasses ?  So that those with really poor eyesight  can read... They go together.

I was thinking we could be good for 2,000 bibles for the project and we buy 500 Bibles as souvenirs for the family of the deceased.  That would cost us P100,000.   P80,000 for the  2,000 bible and P20,000 for 500 bibles as souvenirs for the deceased.

It is part of our mandate as Christians to spread the Word to be part of this Evangelization.

Dale said that Evangelization has been his calling since 2,000
