Penalties from late payments

WHAT :  PENALTIES IMPOSED BY BIR FOR LATE PAYMENTS

Objectives:

1.  To make more cash available for expansion of business and benefits to employees

2   To avoid waste and needless avoidable expense

3.  To develop more professionalism and work related maturity

Background/Reality

1.  I was asked to sign a check for penalty for VAT payment in Holy Gardens Greenhills.  It takes two to tango.  I understand a staff in Greenhills and staff in 3ffb were responsible for this.  Did we negotiate to reduce the penalty?   What caused the penalty -  delays miscommunication?

I could not accept the fact that penalties more than 100% of the cost of original VAT was to be charged and I am signing allowing this anomaly.

2.  We had seminar on CTRP of 1997 where penalties and criminal liabilities wiht non compliance were discussed.  Nothing happened with the seminar?

3.  We discussed and we emailed that our net operating profit (EBIT) is only 13% of the gross collection for hgmp.  Thus a P70,00 penalty requires P700,000 gross collection so that it can be recovered.

4.  If you were the business owner, would you allow such huge amount to be lost to BIR just because there were communications, and tardiness, and I hope not, laziness on our staff. You have money to pay, docs that are complete, and yet somebody just goofed

What do we do.

1. CCD the culprits

2.  Remind everyone that penalty is an anomaly.  It is not a normal occurrence in business.  Avoid.  Stop it.

3. DIN comes from daily practice and good habit.  Every one up and down the organization must practice coming to work and doing what is required on or before time.

  1. I/We HGPMP staff asking for apology for the several penalties that we incurred and settled. But is is not our intention that we want to incur penalties from the said agency(BIR). Honestly, I dont want to suffer our SBU for paying penalties I'm the one who always make follow up at 3rd floor when it comes to BIR payments & for filling matters. Every time na may nakadue na naman na for payment or for remittance pinapaalala ko po sa 3rd floor na sana mapadala in advance kasi nakakahiya na may penalty na case kasi po tuwing magrerenew ng Books of Accounts napepeding paglakad ko po sa BIR kapag may nakikita sila lagi na open case. Kinukulet ko po ang ap even yung mga nakaraan pa pong mga staff. Minsan napapagalitan ko na po sila sa kakafollow up ng BIR. And I admit na minsan natataasan ko pa nga po sila ng boses dahil pagdating po sa BIR masyado po ako nawoworry dahil ako po naglalakad at humaharap sa BIR every year sa pagrerenew ng BOA. Kagaya po nung last na binayadan naming penalty amounting to Php 10,000.00 kahapon for late filing of 1604CF & 2316 year 2015 of witholding taxes dumating po sa amin a day after na ng due date kasi po hindi naideliver ng JRS sa amin sa mismong araw ng due date dahil nagkaabirya po sa kanila.

    Hindi rin po natin maisisi po sa JRS if hindi naipadala on time sa amin kasi po dapat may allowance ang araw ng pagpapadala sa amin ng mga for file sa BIR. Hindi sa pinapasa ko po ang fault sa 3rd floor kundi kinukwento ko lang po case kung bakit po nagkakaroon ng penalty.

    Para po sana maiwasan na pagbayad ng mga penalty dapat po naipapadala po sa amin ng mga 2 days before ng due date para sure na matanggap po namin on time. Lahat po ng pouch na naggagaling po sa inyo dumadating na po sa amin ng hapon between 3-5pm. Dati nung wala pang tax direct thru Landbank po kami nagbabayad ng mga remittances at ang cut off time nila dahil nakacheck na mbtc po tayo 10:00am. Ang filing naman po sa BIR Calasiao pinafile mismo.

    Kaya hindi po namin kagustuhan na magpenalty po SBU namin. Mas nawoworry pa nga po kami kapag nagkakaroon ng penalty dahil ayaw din po namin na masayang lang kinita ng SBU po natin at mapupunta lang sa penalty. At laking pasasalamat po namin na buti na lang may Tax Direct na at hindi na kami magreremit pa sa Landbank tuwing before 10:00am tuwing due date na ng mga remittances.

  2. So far here in Oton we don't experience penalty imposed in our BIR remittances due from late payments. But usually the check payments sent to our SBU always arrived on the day of the due date wherein we had difficulty in following up thru JRS. May we suggest that AP should send us the BIR check payments 2-3 days before the due date so that when circumstances in flight will happen we will not be affected by the delay and penalty imposement from BIR.

  3. SBU's and 3ffb must have unity on paying remittances on time especially when it comes on BIR payments. In La Union, BIR RO3 is very strict on checking necessary attachments upon paying BIR payments on the bank, and on imposing fines and penalties for those who could not pay on the due date. Please take note that banks are accepting cash payments until 3:00 PM only.
    For us not to experience paying penalties again, may we suggest that BIR forms and attachments must be sent to us at least two days before the due date? SBU heads will remind the AP at least five days before the due date. Continuous follow up will also be done by the sbu.
